Gyumri murder: Lawyers demand probe into illegal border crossing attempt
The lawyers acting as legal successors for the family of Avetisyans said Monday that they intend to file a motion to demand an illegal border crossing case against Valery Permyakov, the Russian serviceman standing as the key accused in the murder of the seven-member family.
“Permyakov’s prosecution revealed no deliberate attempt of crossing the border illegally,” said Lusine Sahakyan, one of the lawyers, expressing her disagreement to the finding.
“Although very few records from Permyakov’s testimonies were published, they were enough to make it clear that Armenia is considered a place of exile for those soldiers. Nonetheless they assume airs as though they select the best soldiers to serve in the 102nd military base.”
Sahakyan said she doesn’t understand the logic behind the Russian side’s allegation given that Permyakov was known to have earlier deserted his post eight times before being sent to the Russian military base in Gyumri.
The lawyer said she knows that the murder was not the first ever crime committed by a Russian serviceman in Armenia’s second largest city. She recalled that months after the tragic incident another murder was committed by a Russian serviceman, the victim this time being a private of the same military base.
“There were also reports saying that soldiers remain hungry; that a serious problem too,” Shakyan said, adding that she doesn’t understand why the Russian military court (which sentenced Permyakov to 10 years of imprisonment for desertion and illegal weapon possession) did not publish the part of the ruling referring to the contributory factors. Sahakyan said she finds that fact to be more important for Armenian lawyers than the allegation that the deadly act might have driven a wedge in the Armenian-Russian relations.
Lawyer Yervad Varosyan has an impression that Permyakov is unaware of where he is that what he did.
“Permyakov is behaving in a strange way especially in his ‘yes’ and ‘no’ answers and falling asleep during his own trial,” he said.
According to him, Russia and Armenia arranged an “accelerated” trial.
“The only tendency is to show that Russia imposed a condign punishment on him,” Mr Varosyan said.
According to him, the message to the Avetisyans’ relatives was that Permyakov is not under influence of drugs.
The lawyers believe that Permyakov has health problems as he had regularly been examined by psychiatrists before being drafted.
The issue of his right to military service and carrying arms has not been clarified either. The Russian side did not take any steps to call to account the officials that drafted Permyakov.
“This is the reason for our demands for a forensic medical examination though we do not hope for an answer opposite to that by the Russian side,” lawyer Yerem Sargsyan said.
Lawyer Mihran Poghosyan said that they need details.
“It is important for us to understand how that man describes his actions. And if they do not coincide, it means we are dealing with a man who did not commit the actions,” he said.
Permyakov’s evidence is not fully available, and the Avetisyans’ lawyers have to wait for a trial in Armenia to study the evidence.
